Does My EU Importer Need to Be Named on the Packaging?

Often, yes. EU food labels must include the name or business name and address of the food business operator referred to in Article 8(1) of Regulation (EU) No 1169/2011. If the operator under whose name the food is marketed is not established in the Union, the importer into the Union market becomes the responsible operator for food information.

For a Canadian or US brand with no EU establishment, this usually means the EU importer's name and address, or the details of another correctly structured EU-responsible operator, must be present on the consumer packaging.

It is about responsibility, not branding

The label does not need to make the importer the consumer-facing brand. Your brand can remain prominent. The operator details are a legal identification requirement, showing authorities and consumers which EU-established business is responsible for the food information.

The exact commercial wording should match the real legal structure. Do not print an importer address simply because a logistics company delivered the shipment.

Where can the information appear?

The operator name and address must be on the package or label and be easily visible, clearly legible and not hidden or obscured. It does not generally have to be on the front panel. Some other particulars, such as the name of the food and net quantity, have additional field-of-vision rules.

A compliant sticker or over-label can often be used for a market test if it remains secure, readable and does not cover information that still needs to be visible.

Before printing anything

Confirm who will be the actual importer for the first commercial shipment, who accepts the Article 8 responsibility, and whether the same operator will cover every target country. A packaging change made too early can become obsolete if the distribution structure changes.

Where should the importer address appear?

The responsible operator name and address do not generally have to sit on the front panel. They may appear on the back or side of the pack as long as the mandatory information is easily visible, clearly legible and not hidden or obscured. The address must match the business that actually carries the relevant EU responsibility.
